A8 compensation scheme open for applications

A Notice of Opening in last week’s Larne Times detailed that those who own and occupy property which has been reduced in value by more than £50 by physical factors caused by the use of a new or altered road can seek compensation.

The compensation is being offered under the Land Acquisition and Compensation (Northern Ireland) Order 1973 (Part Two), which provides a right to compensation for people from whom no land has been taken for the construction of the road. The claim period runs until May 30 2018 and there is no upper limit on the amount of compensation.

A DfI spokesperson told the Times: “All claimants must demonstrate how their properties have been affected by the following physical factors, noise, vibration, smell, fumes, smoke, artificial lighting and the discharge on to the property of any solid or liquid substance.

“To date 25 Part Two claims have been received and are currently being processed. We do not have an estimate for the number of expectant claims.”

The cause of the physical factors must be the new or altered road in use. There is no physical limit on how far a property has to be from the works.
