Abuse textersface jail or fine

LONDONDERRY people who send offensive, obscene, indecent or menacing messages via mobile phones or social networking sites could end up in jail or with a £5k fine.

Justice Minister David Ford advised sending abusive messages was a criminal offence.

DUP MLA Lord Morrow asked him whether the improper use of a telecoms network to make nuisance, obscene or harassing phone calls or texts is a criminal offence; and what is the current penalty.

He replied that it was stating: “Under section 127 of the Communications Act 2003 it is an offence to send by means of a public electronic communications network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character.

“The maximum penalty on summary conviction of this offence is six months’ imprisonment and/or a Level 5 fine (currently £5,000).”
