Noel Cahoon, whose address was given to the court as Margaret Street, Portadown, admitted unlawful assault on September 13 last year.

The court heard that police were called to the Brownstown Road home of the injured party at 12.45am.

She alleged that her ex-partner, the defendant, during a drunken argument had pressed his arms against her throat and she had blacked out.

He also caused bruising to her upper arm.

A solicitor representing Cahoon said his client had a completely clear record.

He explained that the defendant had initially been charged with a more serious assault offence but the medical evidence did not support this.

The injured party had gone to her doctor and said she had not actually passed out.

The solicitor added that Cahoon was convicted of a lesser assault charge.

He said his client was a man of good character who had never had been involved in anything like this before.

The relationship between him and the victim was now over and he had no contact with her.

But, he added, it was a domestic incident and that had to be taken into account.

The case had been adjourned from a previous court so that a pre-sentence report could be obtained.

District Judge, Mr Mervyn Bates, said because it was a domestic incident he could not treat it by way of a fine and imposed 120 hours community service.
