Broke into home of his ex-partner

When he got into the home of his ex-partner a 22-year-old man was in breach of a court order after police found him asleep in the front bedroom.

Nilton Oliveira, Churchill Park, Portadown, faced charges of criminal damage to a window and breach of a non molestation order on August 30 last year.

The case had been adjourned from a previous court so that a pre-sentence report could be obtained. But Oliveira failed to meet the appointments with probation and no report was available.

District Judge, Mr Mervyn Bates, said the defendant had been given two opportunities to engage with probation and would not get a third chance. He added that he would deal with the matter without a report.

The court heard that at 4.34am police received a 999 call from the defendant’s ex-partner. She was screaming for help saying that Oliveira had broken the lock on a rear window and climbed into the house.

He wanted to stay the night. She said no but he grabbed her. Oliveira was found asleep in the front bedroom.

A barrister representing the defendant said he had been in court in the summer of last year for similar matters concerning the same injured party but he now accepted their relationship was at an end. He added that Oliveira had now settled down with a new partner and there had been no further incidents.

Judge Bates described Oliveira’s behaviour as unacceptable and had already been given a custodial sentence for breach of a non molestation order.

Oliveira was sentenced to two months in prison for each offence with the terms to run concurrently.
