Claimed nurse told him not to apologise

In the dock was Jamie Mullan (19) of Sherriff’s Road, and the court was told that this was his third breach of bail. The court was told that Mullan had breached his bail when he was alleged to have been putting the bins outside.

A police constable told the court that they had received a report from Group 4 Security that Mullan did not return home until 9.12pm.

“His curfew is until 9pm,” the investigating constable said.

“The defendant said that his taxi had picked him up later,” she said.

“Later, at 10.07pm, we received a report that he had been outside from 10.07pm until 10.15pm.

“Police rang the phone and a female who answered said that he was outside putting the bins out,” she said.

During the brief hearing, police told the District Judge, Barney McElholm, that they objected to Mullan being admitted to bail given his poor record.

Solicitor Paddy McDermott, who appeared for Mullan, said that it unlikely that the defendant would have gone far in eight minutes.

“Whilst this is the third breach of bail, it is at the lower end,” he said.

“On Sunday night he had been at a friend’s house and taken a taxi back and it had been busy. The second time he had gone outside to get some privacy,” he said.

On hearing the evidence, District Judge Barney McElholm said that if the defendant had stuck to the same story it would make life easier.

“Was he putting the bins out or getting some privacy,” he said.

“Just get one story and stick to it whether it is true or not. I‘ll let him off with a warning but if he breaches again I will remand him in custody. There’s something going on here.”

Mullan is due back in court on June 23.
