Bail application to alter residential address is turned down by District Judge

The District Judge at Londonderry Magistrates Court has refused a bail application which would allow a man to live with his pregnant partner.

Ivan Victor McMichael, of Hyacinth Avenue, Ballykelly, had applied under the Criminal Justice Order 2003 and 2005 to vary police bail to allow him to move back in with his partner, who lives in Apex Housing accommodation in the Londonderry District.

However, a PSNI constable said that police opposed the application as McMichael faced a charge of harassment relating to a woman who lived next door to McMichael’s partner, and if he was allowed to live at the Apex Housing address the woman he was accused of harassing felt scared to be on her own and scared to go out in case he damaged her property. She told the Court that Apex Housing had received complaints from other residents and Apex did not want him living there.

Keith Kyle, defending, said his client had been living in the area for approximately 12 years and was living away from his family.
