Denied bail variation to return for Christmas

A Dungannon woman accused of assaulting her neighbour has been refused a bail variation to return home to be with her daughter at Christmas.

Appearing before East Tyrone Magistrate’s Court on Wednesday was Kayleigh Davidson, 27, from Cloneen Avenue, who is accused of an ABH assault and threats to kill a woman on November 28th.

A police constable told the court that the address the defendant wished to return to was next door to the injured party.

She disclosed that the allegations sprung from a request for Davidson to turn down music.

The defendant’s solicitor, Mr Ruairi Maguire, told the court that the application was because Ms Davidson’s daughter remained with her grandparents in Dungannon while her bail address was in Coalisland.

“That address was not considered an appropriate one (for the child).

“The upshot is she is not living with her child. It is a difficult application but we have Christmas coming up,” he said.

“They hope that they will reunite in that house.

“The parties lived next door to each other for three years with no issue (before the allegation).

“At some point the case will end and she will be moving back in there. Conditions could be put in place sooner rather than later.”

Refusing bail, District Judge John Meehan told the defendant: “The answer is obvious. There is no question of moving back... to beside the alleged victim to be reunited with her daughter.”

The case will continue in January.
