Eglinton dog owner hit for £706 after ‘30 stitches’ attack

THE owner of an Alsatian/Akita cross-breed that caused severe lacerations to a dog warden’s arm and leg during an attack in Eglinton in April 2010 was fined £500 and ordered pay costs of £206 at Londonderry Magistrates Court in March, according to a Derry City Council report.

A report by the Town Clerk due before the Council Environmental Services Committee tomorrow outlines details of the legal action arising from an attack at a dwelling in Glenrandel, Eglinton, on April 21, 2010 when a council dog warden called to collect the unwanted animal and was attacked. He was hospitalised and required 30 stitches.

The document quotes from a report by the City Secretary and Solicitor and refers to the prosecution of dog owner Caroline Corr for an offence under Article 29.1(A) of the Dogs (Northern Ireland) Order 1983 as amended by 4(3) of the Dangerous Dogs (Northern Ireland) Order 1991.

The report states that “Caroline Corr being a person in charge of a dog, namely a Japanese Akita/German Shepherd, committed an offence by virtue of the fact that a Dog Warden, Malachy Duddy was attacked and caused injury by the said dog.”

It adds: “On 30th March 2011, I attended before District Judge Mr McElhome, with Counsel, as the prosecution was contested. Caroline Corr was convicted of offences under Article 29.1(A) of the Dogs (Northern Ireland) Order 1983 as amended by 4(3) of the Dangerous Dogs (Northern Ireland) Order 1991.

“The Magistrate ordered that the defendant be fined £500.00 (Five Hundred Pounds) on each offence, ordered that the defendant pay the sum of £175.00 (One Hundred and Seventy Five Pounds) towards Council’s legal costs and the outlay of £31.00 (Thirty One Pounds) representing court fees on the Summons, making a total monetary penalty of £706.00 (Seven Hundred and Six Pounds). The Defendant was allowed 26 weeks to pay.” The dog was put down.
