Fell out with doctor 
and refused to give sample

A man who ‘fell out with the doctor’ and refused to give a sample of blood or urine was banned from driving for 14 months last Wednesday at Craigavon Magistrates Court.

Curtis Whitla (19), Rectory Road, Lurgan, was also fined £170 for failing to provide a specimen on April 24. The court heard police were called to Craigavon Area Hospital after reports of a car being driven by someone who seemed to be under the influence of alcohol. They observed a vehicle going backwards and forwards in a car park. When they spoke to the defendant his speech was slurred and he was slow to react. An impairment test was carried out and Whitla was arrested. He refused to give a blood or urine sample.

Mr Richard Monteith, defending, said Whitla fell out with the doctor and appreciated this was going to cost him his licence. District Judge, Mr Mervyn Bates, said because they did not have the final test they could not tell what the reading would have been.
