Five year ban for motorist

A Dungiven man was disqualified from driving for five years when he appeared before Limavady Magistrates Court.

Brendan Aloysious Robert Mullan (49) of Derryork Road was charged with driving while unfit, driving without a licence and driving without insurance at Derryork Road at 1.05am on December 12.

Police making the detections said there was a strong smell of alcohol on his breath and when he exited the vehicle he was unsteady on his feet.

The court heard Mullan “freely admitted” he did not have insurance and that he had no driving licence.

A breath test gave a reading of 100mcgs per 100mls of breath.

Defence for Mullan said given the high reading and that Mullan had “a record with some serious convictions”, he had “placed his liberty in a precarious position”. He said Mullan had bought a car and he had gone to pick it up regarding repairs, and he had been drinking. He said Mullan had not consumed alcohol since that night and the car had been disposed of.

Mullan was sentenced to five months in jail, suspended for three years, and a five-year driving ban and fined £100.
