Struck out after he was pushed several times

Paul Daniel Magee (29), Island View, Lurgan, admitted disorderly behaviour on June 22 this year at William Street, Lurgan.

He was fined £200, with a £15 offender’s levy, and bound over in the sum of £500 to keep the peace and be of good behaviour for 18 months.

The court heard that at approximately 1.30am Magee was seen repeatedly punching at another person and when he was arrested he acknowledged he had been fighting and was aggressive.

The injured party did not make a complaint and there was no charge for assault.

Mr Conor Downey, representing the defendant, said that the CCTV showed that the person who had been involved had been fighting with several other persons and was the aggressor.

He added that Magee accepted he did swing 
several punches but this ceased when the police arrived.

Mr Downey said the other person had been aggressive and pushed Magee several times in the chest.

District Judge, Mr Mervyn Bates, said he was concerned that the 
defendant had a previous conviction for disorderly behaviour.

Mr Downey said Magee had not come out looking for trouble but this other person was antagonising 
several people in the area.
