Suspended jail term and fine for Dunloy man

A 24-year-old unemployed painter from Dunloy has been given a suspended prison sentence and fined £250 when he appeared at North Antrim Magistrates Court in Coleraine last Wednesday on a charge of disorderly behaviour.

Patrick Magowan of 109A Bridge Road pleaded guilty to the offence which took place on November 1 last at Kelly’s Nighclub complex, in Portrush. A charge of obstructing a police constable in the execution of his duty was withdrawn.

A prosecution solicitor told the court that just before 1 a.m. on the morning in question defendant was at Kelly’s night club when he began shouting and swearing.

Magowan continued to shout and swear and was subsequently arrested for being disorderly. The solicitor added that defendant shouted various obscenities at police calling them black b------s.

A defence solicitor said his client had consumed a considerable amount of alcohol on the night and was currently receiving treatment for other medical conditions.

District Judge, Mr. Richard Wilson, reminded Magowan that he had been before the court in January of 2007 and in March of the same year for disorderly behaviour and that last July, he received a restorative caution.

“How many chances do you think you need before you learn to behave yourself. If your are back for a smiliar type of public order offence in the next two years you are starting off with one month,” Mr. Wilson added.
