Suspended jail term for man who exposed himself

A 61-year-old man who exposed himself was given a suspended prison sentence at Banbridge Magistrates Court last Thursday.

Edward William Allen, of Reilly Court, Banbridge, admitted that on November 1 last year he intentionally exposed his genitals intending someone would see him and be caused alarm or distress.

The case had been adjourned from a previous court so that a pre-sentence report could be obtained.

A barrister representing Allen said that on the night in question he had taken a significant amount of whiskey and beer and he had a hazy recollection of events.

Deputy District Judge Chris Holmes said he had a difficulty with what was contained in the report.

He pointed out that Allen had pleaded guilty to the ‘very specific’ intent in the charge but when he met with probation he stated he was ‘just having a pee’.

The barrister said that his client did accept the charge.

Judge Holmes said if he did not accept what he did probation was ruled out and he was not fit for community service so he was left with only two options, send him to prison or suspend the sentence.

Allen’s barrister said it was a serious offence but he had a clear record and had pleaded guilty from the outset.

The judge said the matter crossed the custody threshold and imposed a sentence of four months in custody which he suspended for two years.

He hoped it would be a salutary lesson to the defendant and told him to go away and not re-offend.
