Suspended sentences for order breaches

Daniel McConville (41), Moyraverty Centre, Craigavon, admitted breaching a non molestation order on March 31 and again on April 20 this year.

For the first offence he was sentenced to three months in prison and for the second matter four months in custody.

The sentences are to run consecutively, making a total of seven months, and they were suspended for two years.

The court heard that on the first occasion the injured party received phone calls and from the caller ID she knew they were from the defendant. She felt harassed and intimidated by the calls.

On a later date there were two further calls and again she felt harassed and intimidated.

When interviewed McConville said: “She’s just trying to stop me talking to the kids.” He was charged and released on police bail.

On April 20 the injured party heard shouting at the front of her home and recognised the defendant’s voice. He was prohibited from entering Drumbeg under the non molestation order.

McConville was holding a bottle of Buckfast and said ‘who gives a f—k’. He was aggressive towards police when he was arrested for the breach of the order. When he appeared in court on April 21 bail was refused.

Mr Conor Downey, defending, said McConville had spent a short period in custody and this had focussed his mind.

He added that his client’s relationship with the injured party had floundered because of his alcohol intake but he had now contacted addiction services.
