Swatragh man disqualified as director after building firm’s collapse

The undertaking came from Eugene Bradley (47) of Ringsend Close, Swatragh, Maghera in respect of his conduct as a director of EJB Construction Services Ltd. (“the Company”).

The Company carried on the business of construction from Ringsend Close, Swatragh, Maghera and went into liquidation on 15 December 2011 with no estimated total assets available to creditors, liabilities to unsecured creditors of £297,511, and an estimated deficiency as regards creditors of £297,511. After taking into account the losses incurred by members (the shareholders) of the Company the total estimated deficiency was £297,611.

The Department accepted the disqualification undertaking from Eugene Bradley on 10 July 2014 based on the following unfit conduct which solely for the purposes of the disqualification procedure was not disputed:

Causing and permitting the Company to retain a total of £145,968 properly due to the Crown in respect of PAYE, NIC and VAT;

Causing and permitting the Company to present 69 cheques with a value of £90,464.70 to the First Trust Bank without due regard to there being sufficient funds available to honour them. One of these cheques valued at £374.40 was returned for a second time;

Failing to file accounts for year ended 30 November 2008 contrary to the requirements of Companies (Northern Ireland) Order 1986.
