Tullyhogue drink driver took car out ‘to get hamburger’ court told

A Tullyhogue man who took his vehicle out to get a hamburger after consuming alcohol at home has been fined and disqualified from driving.

Martin Boyle, 49, of Gortagammon Road, Tullyhogue was charged with driving with excess alcohol in breath following an incident on October 22.

A court heard how police were called to a report of a road traffic accident at Fountain Road. They spoke to the defendant whose eyes were glazed and conducted a roadside breath test which he failed. He was taken to the station were a further sample revealed 44mg/100ml of breath.

A defence solicitor for Mr Boyle said his client had consumed a few drinks at home and ‘foolishly’ decided to drive to get a hamburger thinking he was OK to drive. District Judge John Meehan fined him £265 and disqualified him for 12 months.
