Was aggressive towards police

A 33-year-old man was given community service and put on probation when he appeared last Thursday at Banbridge Magistrates Court.

Niall McCauley, Primrose Gardens, Banbridge, admitted disorderly behaviour and resisting police on October 2 this year.

The case was adjourned from a previous court so that a pre-sentence report could be obtained.

A public prosecutor said that at 10.25pm police received a report of a disturbance at Maryville Crescent in Banbridge.

They saw the defendant who was extremely intoxicated and police offered to convey him home.

When he got outside he became abusive and was aggressive, shouting at the arresting officer. McCauley was warned about his behaviour but continued and was arrested for disorderly behaviour.

He began to resist and had to be taken to the ground where he kicked out at a constable. In reply to a caution he said: “Really.”

The defendant was taken to Lurgan custody suite but was deemed unfit for interview and was charged the next morning.

A solicitor representing the defendant said he had now secured work and was due to start on January 4. She added that he would consent to community service but because he was starting work in January there may be a difficulty.

Deputy District Judge Philip Mateer said that police have to respond when a public order incident arises and they were met with the defendant who was extremely intoxicated.

He pointed out that McCauley had previous convictions for disorderly behaviour. Judge Mateer sentenced the defendant to a combination order of 80 hours community service and 12 months probation with the condition he participates in the alcohol counselling programme.
