Judge dismisses assault charge against woman after defence argues victim ‘not someone in fear’

A Magherafelt woman accused of common assault and criminal damage has had the case against her dropped.

The court heard how Deirdre White from Roshure Drive in Magherafelt had allegedly assaulted and ripped the shirt of a man she was in a relationship with on August 11 last year.

In her defence, counsel argued about the length of time the case had been before the courts without a decision, after which Judge White agreed to dismiss the charges against Mrs White.

The injured party had submitted a doctor’s letter to the prosecution saying he could not attend court a day before the April 15 hearing.

Her lawyer went on to tell court the alleged victim had gone through electric gates at the defendant’s home and drove up to her property as recently as March 10 this year - “not the actions of someone in fear” he argued.
